Pre-Order Terms of Sale
These terms apply when you reserve an Away Halo S2 by paying a deposit on away.au. The seller is Secret Agency Pty Ltd ABN 35 613 451 371, trading as Away ("we", "us"). You accept these terms when you tick the box at checkout. Our general Terms of Use and Privacy Policy also apply.
1. What you are paying for
- The deposit is A$50. It reserves one Away Halo S2 from the first production run of 1,000 units, made in Bellingen NSW.
- The full price is A$499, including GST. Your deposit counts towards it, so the balance is A$449.
- You can also reserve with the same A$50 deposit when you buy an Away Sleep Reset. These terms apply to that deposit too.
- If you paid an A$49 deposit before October 2026, your balance stays at A$450 and everything else here applies to you.
- Your price is fixed at A$499 once your deposit is paid, even if the retail price changes later.
- Shipping within Australia is free. This run ships to Australian addresses only.
- One deposit reserves one unit.
2. Paying the balance
- When your unit is ready to dispatch, we will email you a link to pay the balance and confirm your delivery address.
- You will have 14 days from that email to pay. We will send a reminder before the 14 days run out.
- If the balance is not paid in that time, we will release your unit and refund your deposit in full, as set out in section 5.
- Your unit is dispatched only after the balance is paid.
3. Delivery timing
We estimate dispatch in late 2026. This is an estimate, not a guaranteed date. Production is small and local, and it can move. If the estimate changes, we will email you with the new timing, and you can cancel for a full refund at that point or any time before dispatch.
4. Cancelling your reservation
- You can cancel at any time before your unit is dispatched. You do not need to give a reason.
- To cancel, email marty@away.au from the address you ordered with and include your order reference.
- If you cancel before paying the balance, we refund your deposit in full.
- If you cancel after paying the balance but before dispatch, we refund everything you have paid, A$499 in total.
- Once your Away Halo has been delivered, cancellation under these terms no longer applies. Your rights under the Australian Consumer Law still do (see section 8).
5. How refunds are paid
- Refunds are paid by bank deposit into an Australian bank account you nominate. They are not returned to the card you paid with.
- The exception is a deposit paid as part of an Away Sleep Reset order. It is refunded to the card used for that order.
- When a refund is due, we will email you and ask for the account name, BSB and account number. The account should be in your name.
- We pay the refund within 10 business days of receiving those details. Your bank may take a further 1 to 2 business days to show it.
- Refunds are for the full amount paid, with no fees or deductions.
- We will never ask for your card number, passwords or one-time codes. If you are unsure whether a request is from us, reply to your original order email or contact marty@away.au.
- We use your bank details only to pay your refund, and we handle them under our Privacy Policy.
6. If we cannot deliver
If the production run does not go ahead, or we cannot supply your unit, we will tell you by email and refund everything you have paid, in the way set out in section 5.
7. Regulatory review
The Away Halo is a consumer wellness device. Its regulatory classification is pending review, and shipment is subject to clearance. If any requirement changes the product or stops us shipping it before dispatch, we will contact you and refund everything you have paid. If the change is to the product itself, we will describe it and you can choose to keep your reservation or take the refund.
8. Your rights under Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights. Once delivered, your Away Halo is covered by those guarantees in the same way as any other purchase.
9. Changes to these terms
If we update these terms, the version you accepted at checkout continues to apply to your reservation unless you agree to a newer version.
10. Governing law
These terms are governed by the laws of New South Wales, Australia.
